Conclusion of a travel contract<\/strong><\/p><p style=\"padding-left: 40px;\">1.1. By registering for a trip or making a booking, the\ncustomer makes a binding offer to TrEE Management\nto conclude a travel contract. This offer is based on the travel description and all additional information from TrEE Management for the respective trip.<\/p><p style=\"padding-left: 40px;\">1.2. The booking can be made in writing, verbally, by\ntelephone or via screen systems.<\/p><p style=\"padding-left: 40px;\">1.3. The contract is concluded upon acceptance by TrEE Management, which is confirmed by a booking confirmation.<\/p><p style=\"padding-left: 40px;\">1.3. The contract is concl1.4. If the content of the booking confirmation differs\nfrom the content of the client booking, this constitutes\na new offer from TrEE Management. The contract is\nconcluded on the basis of this new offer when the\ncustomer declares acceptance or starts the trip.uded upon acceptance by TrEE Management, which is confirmed by a booking confirmation.<\/p><p style=\"padding-left: 40px;\">1.5. If the travel conditions of TrEE Management are\nnot available to the customer when registering by\ntelephone, they will be sent with the travel\nconfirmation\/invoice.<\/p><p style=\"padding-left: 40px;\">1.6. The scope of the contractual service is determined\nfrom the respective service description, as well as from\nthe other pre-contractual information and the relevant\ninformation in the travel confirmation\/invoice. Other\nhotel or service provider brochures or information are\nnot relevant.<\/p><p style=\"padding-left: 40px;\">1.7. When booking flights, the customer will be\ninformed of the identity of the operating airline in\naccordance with Regulation (EC) 2111\/2005. If this is\nnot yet known at the time of booking, the customer will\nfirst be informed of the identity of the likely operating\nairline and will be informed as soon as the identity is\nfinally known. A change in the operating airline after\nbooking will be communicated immediately.<\/p><p><strong>2. Payment Conditions<\/strong><\/p><p style=\"padding-left: 40px;\">2.1. After conclusion of the contract (and - in the case\nof booking a package tour- upon receipt of the security\ncertificate in accordance with $ 651r of the German\nCivil Code), a deposit of 40% of the travel price is due.<\/p><p style=\"padding-left: 40px;\">2.2. The remaining payment must be made no later\nthan 30 days before the start of the trip without further\nrequest.<\/p><p style=\"padding-left: 40px;\">2.3. For bookings made within 30 days of the start of\nthe trip, the entire travel price is due immediately and\nmust be paid by direct debit, credit card or online\npayment system.<\/p><p style=\"padding-left: 40px;\">2.4. If the customer does not pay the deposit and\/or\nthe remaining payment on time, TrEE Management is\nentitled to withdraw from the contract and demand\ncompensation from the customer in the amount of the\ncorresponding cancellation fees, provided that there\nwas no travel defect that justified withdrawal.<\/p><p style=\"padding-left: 40px;\">2.5. Withdrawal and cancellation fees are due\nimmediately.<\/p><p><strong>3. Withdrawal by the customer before the start of\nthe trip \/ cancellation costs<\/strong><\/p><p style=\"padding-left: 40px;\">3.1. The customer can withdraw from the contract at\nany time before the start of the trip. It is recommended\nthat the withdrawal be declared in writing to avoid\nmisunderstandings.<\/p><p style=\"padding-left: 40px;\">3.2. In the event of withdrawal, TrEE Management can\ndemand appropriate compensation.<\/p><p style=\"padding-left: 40px;\">3.3. The amount of compensation is determined by the\ntravel price. When calculating the compensation, saved\nexpenses and possible alternative uses of the travel\nservice by TrEE Management are taken into account.<\/p><p style=\"padding-left: 40px;\">3.4. The payment and cancellation conditions\nannounced in the offer and recognized as part of the\ncontract apply in this respect.<\/p><p><strong>4. Rebooking and replacement persons<\/strong><\/p><p style=\"padding-left: 40px;\">4.1 The customer can request that a third party assume\nthe rights and obligations arising from the travel\ncontract instead of him until the start of the trip. TrEE\nManagement can object to the change if the third party\ndoes not meet the special travel requirements or if\nlegal regulations prevent this.<\/p><p style=\"padding-left: 40px;\">4.2 The additional costs incurred by the participation of\nthe replacement person or a rebooking are calculated\nbased on the time spent in the time sheet plus the\nrebooking costs incurred<\/p><p><strong>5. Customer obligations<\/strong><\/p><p style=\"padding-left: 40px;\">5.1 The customer is obliged to report any defects to\nTrEE Management immediately and to request\nremedial action.<\/p><p style=\"padding-left: 40px;\">5.2 If the customer negligently fails to report a defect,\nthere is no entitlement to a reduction in the travel price\nor compensation.<\/p><p style=\"padding-left: 40px;\">5.3 The customer is obliged to check all travel\ndocuments (e.g. booking confirmation, tickets) for\naccuracy and to inform TrEE Management immediately\nif there are any discrepancies.<\/p><p style=\"padding-left: 40px;\">5.4 TrEE Management strongly recommends that\ndamage or delays in delivery during air travel be\nreported immediately on site using a damage report\n(P.I.R.) to the responsible airline. Airlines generally\nrefuse to refund if the damage report has not been\nfilled out. The damage report must be submitted within\n7 days of delivery in the case of damage to luggage and\nwithin 21 days of delivery in the case of delay. In\naddition, damage to or misrouting of luggage must be\nreported in accordance with section 5.1.<\/p><p style=\"padding-left: 40px;\">5.5 The travel manager or other representatives of TrEE\nManagement at the holiday destination are not\nauthorized to accept claims.<\/p><p><strong>6. Liability<\/strong><\/p><p style=\"padding-left: 40px;\">6.1. TrEE Management is liable within the scope of the\nduty of care of a prudent businessman for the\nconscientious preparation of the trip, the careful\nselection and monitoring of the service providers, the\naccuracy of the service description, and the proper\nprovision of the contractually agreed travel service.<\/p><p style=\"padding-left: 40px;\">6.2. TrEE Management is not liable for service\ndisruptions, personal injuries and property damage in\nconnection with services that are merely arranged as\nthird-party services (e.g. excursions, rental cars,\ntransport services to and from the advertised\ndeparture and destination locations)), provided that\nthese services are expressly identified as third-party\nservices in the travel advertisement and the booking\nconfirmation.<\/p><p style=\"padding-left: 40px;\">6.3. TrEE Management is not liable for service\ndisruptions that are related to services that were\nmerely arranged as third-party services.<\/p><p style=\"padding-left: 40px;\">6.4. Transport is carried out on the basis of the\nconditions of the respective transport company, which\ncan be made available on request. The rights and\nobligations of TrEE Management and the travelers\nunder travel contract law and these detailed travel\nconditions are not restricted by the conditions of the\nrespective transport company.<\/p><p style=\"padding-left: 40px;\">6.5. TrEE Management is not liable for service\ndisruptions due to force majeure, such as natural\ndisasters, strikes, unrest or pandemics.<\/p><p><strong>7. PASSPORT, VISA, CUSTOMS, FOREIGN EXCHANGE,\nHEALTH REGULATIONS<\/strong><\/p><p style=\"padding-left: 40px;\">7.1 The customer is responsible for obtaining and\ncarrying the officially required travel documents, any\nvaccinations that may be required and for complying\nwith customs and foreign exchange regulations.\nDisadvantages resulting from non-compliance with\nthese regulations are at his expense.<\/p><p style=\"padding-left: 40px;\">7.2 TrEE Management is not liable for the timely\nissuance and access to necessary visas by the\nrespective diplomatic representation if the customer\nhas commissioned it to obtain them, unless TrEE\nManagement has culpably violated its own obligations.<\/p><p><strong>8. Other<\/strong><\/p><p style=\"padding-left: 40px;\">8.1 TrEE Management does not participate in dispute\nresolution proceedings before a consumer arbitration\nboard.<\/p><p style=\"padding-left: 40px;\">8.2 OS platform The European Commission provides a\nplatform for online settlement of consumer disputes at\nhttp:\/\/ec.europa.eu\/consumers\/odr\/. TrEE\nManagement does not currently participate in this\nvoluntary alternative dispute resolution procedure.\nTherefore, our customers cannot use the OS platform.<\/p><p><strong>9. Choice of law and place of jurisdiction<\/strong><\/p><p style=\"padding-left: 40px;\">The law of the Federal Republic of Germany applies.\nThe place of jurisdiction for all disputes arising from\nthe travel contract is the registered office of TrEE\nManagement, provided that the customer is a\nmerchant, a legal entity under public law or a special\nfund under public law or has no general place of\njurisdiction in the country.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>TrEE Management Company Travel &#038; Event Experts Allgemeine Gesch\u00e4ftsbedingungen (AGB) der TrEE Management Company \u2013 Travel &amp; Events GmbH (TrEE Management) 1.
